SELLER: LEONARDO OPTICS SRL, a legal entity of Romanian nationality, registered with the National Trade Register Office attached to the Bucharest Court under no. J40/8848/2015, with C.U.I RO34790869, with registered office located in the municipality of Bucharest, Sector 1, Strada Ion Cimpineanu, no. 11, Modul Q, room 407, Union International Center, 4th floor.

SITE: represents the website belonging to and managed by LEONARDO OPTICS SRL, hosted at www.leonardo-optics.ro, through which the User/Buyer/Client has access to information regarding the products offered by LEONARDO OPTICS SRL, through the website www.leonardo-optics.ro.

ONLINE STORE: refers to www.leonardo-optics.ro

PHYSICAL STORE/SHOWROOM: the store from which an Order can be picked up, if the Buyer/Client so chooses. The pick-up point will be in the municipality of Bucharest, Sector 1, Strada Ion Cimpineanu, no. 11, Modul Q, room 407, Union International Center, 4th floor.

BUYER/CLIENT: can be any natural person or legal entity, who creates an Account on the Site and makes, respectively, finalizes an Order on the online store and who has accepted the Terms and Conditions of Use of this SITE, fulfilling in this regard all the requirements of the registration process. The Buyer/Client is also known as a consumer, in accordance with the provisions of Law no. 363/2007.

ACCOUNT: the section of the SITE consisting of an e-mail address, or, as the case may be, a username and a password that allows a single Buyer/Client/User to submit the Order and that contains information about the User/Client/Buyer and his/her history on the SITE (Orders, warranties, Products, etc.). The User/Buyer/Client is responsible for and will ensure that all information entered when creating the Account is correct, complete and up-to-date. The Account, as defined, allows a single Buyer/Client/User access to restricted areas of the site through which access is made to the information provided by the consumer for the current order, for previous orders or within the process of updating the information related to the account.

FAVORITE: Wishlist section of the Account that allows the Buyer/Client/User to create Lists of Favorite Products, which he/she wishes to follow with a view to a possible purchase.

MY CART: section of the Account that allows a single Buyer/Customer/User to add the Products they wish to purchase at the time of addition or at a later time.

ORDER: an electronic document that acts as a form of communication between the Seller and the Buyer/Customer through which the latter transmits to the Seller, through the SITE, his intention to purchase Products from the SITE.

PRODUCTS: any product listed on the SITE, including the products mentioned in the Order, which are to be supplied by the Seller to the Buyer/Customer as a result of the concluded Contract.

DISTANCE CONTRACT: any order confirmed by the Seller. According to the definition contained in the Emergency Ordinance 34 of 4 June 2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and completion of certain normative acts, art. 2, point 7, as transposed by Directive 2011/83/EU on consumer rights: any contract concluded between a professional and a consumer within a distance sales or service provision system organised without the simultaneous physical presence of the professional and the consumer, with the exclusive use of one or more means of distance communication, until the moment the contract is concluded.

CONTENT: this represents:

 all information on the SITE that can be visited, viewed or accessed using electronic equipment;

 all data and elements within the SITE including, but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content, patents, models, images, texts, photographs, videos, graphic maps, etc.

 the content of any commercial communication transmitted to the Buyer/Client/User by the Seller by electronic means and/or any other means of communication available;

 information related to the Products and/or the rates charged by the Seller in a certain period;

 data relating to the Seller.

COMMERCIAL COMMUNICATIONS: any type of message sent by the Seller (such as: newsletter, e-mail, webpush, etc.) containing general and thematic information, information regarding the Products viewed or purchased on the site, information regarding offers or promotions, information regarding products added to the Account/My Cart section as well as other commercial communications such as market research and/or opinion polls.

LINK: refers to a keyword or the address of a site outside or inside the online store which, when clicked, initiates the visit to a new internet page.

CLICK: engaging a link or creating an activity on the online store. Example: general navigation of the site.

COURIER: any legal entity that provides express courier services, at the Seller's choice.

SPECIFICATIONS: all specifications and/or descriptions of the Products as specified by the Buyer/Customer in the Order.

COMMENT: critical assessment or observation regarding a specific Product. All comments expressed by the User/Buyer/Client sent to the Seller will be formulated in a decent manner, without the use of offensive expressions.

SUBMISSION: sharing personal data of the Buyer/Client/User with the online store. Example: subscribing to the newsletter or completing an Order, by registering on the online store and sharing the e-mail address.

DOCUMENTATION: these Terms and Conditions, including the policies of LEONARDO OPTICS SRL. displayed on the website www.leonardo-optics.ro.

CAMPAIGN/PROMOTION: the action of displaying for commercial purposes, a finite number of Products with a limited and predefined stock, for a limited period of time established by the Seller and published on the SITE.

TRANSACTION: the collection or reimbursement of an amount resulting from the sale of a Product by the Seller to the Buyer/Customer, by using the services of the card processor approved by the Seller, regardless of the delivery method.

PAYMENT METHOD: the method by which the Seller accepts payment for the purchased Products. The main method of payment for the Products will be made via virtual POS, and as alternative methods it will be possible to pay in cash on the day of delivery of the Order, or by picking up from the physical store at the time of presentation of the Buyer/Customer at the headquarters of LEONARDO OPTICS SRL, in the municipality of Bucharest, Sector 1, Strada Ion Cimpineanu, no. 11, Modul Q, room 407, Union International Center, 4th floor.

ORDER PLACEMENT: Orders can be placed via email, SMS, WhatsApp or by phone at the number displayed on the SITE.

ABUSE: represents the use of the SITE in a manner contrary to practice in the field, regulations and legislation in force or in any other manner that may cause damage to the company LEONARDO OPTICS SRL.

2. ONLINE SALES POLICY

By accepting the Terms and Conditions on this page, it is understood that the User/Buyer/Customer, a natural person, is of at least the age of majority, according to the laws of Romania.

The use, including but not limited to accessing, visiting and viewing, of the content implies the acceptance by the User/Buyer/Customer of this list of Terms and Conditions. The User/Buyer/Customer undertakes to permanently monitor the Terms and Conditions, which may be updated, modified and supplemented.

Access to place an Order is allowed to any User/Buyer/Client. For justified reasons, Leonardo Optics reserves the right to restrict the User/Buyer/Client's access to place an Order and/or to some accepted payment methods, if it considers that due to the conduct or activity of the User/Buyer/Client on the SITE, his/her actions could harm Leonardo Optics in any way.

Communication with the Seller can be achieved by direct interaction with him/her or through the addresses and methods mentioned in the Contact section of the SITE. The Seller is free to manage the information received without having to provide justification for this.

In the event of an unusually high volume of traffic coming from an internet network, Leonardo Optics reserves the right to ask the User/Buyer/Client to enter a captcha-type validation code, in order to protect the information within the SITE.

Lonardo Optics may publish on the SITE information about Products, and/or Promotions/Campaigns practiced by it on the SITE during a certain period of time and within the limit of available stock.

All prices related to Products displayed on the SITE are expressed in lei (RON) and include VAT.

Access to register an Order is made exclusively by accessing the publicly available website www.leonardo-optics.ro.

By using the SITE, the User/Buyer/Client is solely responsible for all activities arising from its use. Also, the User/Buyer/Client is liable for any material, intellectual or electronic damages or any other nature caused to the SITE, its content, or any third party with whom Leonardo Optics SRL has concluded contracts, in accordance with Romanian legislation in force.

All information used to describe the Products available on the SITE (static/dynamic images/multimedia presentations) does not represent a contractual obligation on the part of the Seller, these being used exclusively for presentation/information purposes.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The content of the website www.leonardo-optics.ro, including but not limited to: images, static images, dynamic images, logo, texts and/or multimedia content, patents, models, photographs, videos, stylized representations, commercial symbols, web graphics elements, scripts, software, design rights, model rights, patents, registered trademarks, graphic maps, databases presented on the SITE constitute the exclusive property of Leonardo Optics SRL and is protected by the Law on Copyright and Related Rights and by the laws on intellectual and industrial property.
